Because of the current inherent complexities of agency relations, SAG-AFTRA has recently received numerous requests to clarify the current state of affairs with respect to its franchised agents in the New Mexico market area.

Pursuant to SAG-AFTRA’s Agency Regulations, members who wish the protection of SAG-AFTRA in their relationships with their agents are required to choose from the SAG-AFTRA franchised agents currently available in the New Mexico market. A list of those agents can be obtained for SAG-16(g)-franchised agents and for AFTRA-12-C-franchised agents. Representational relationships with non-franchised agents in the New Mexico market do not comply with SAG-AFTRA membership requirements. This precaution is necessary in order to ensure that our members’ rights are fully protected in their relationships with their agents. Franchised agents (as well as the SAG-AFTRA members they represent) are protected by, and bound to, the terms and conditions of Rule 16(g), aka the Legacy SAG Agency Regulations and Rule 12-C., aka the Legacy AFTRA Agency Regulations. Agents that are not franchised are outside SAG-AFTRA’s jurisdiction, and our members should be careful not to place themselves in potential violation of SAG-AFTRA membership rules by deciding to work with them.
