It has come to the attention of the SAG-AFTRA Stunt & Safety Department that producers have engaged stunt performers to work under inappropriate schedules of the Producer-SAG-AFTRA Codified Basic Agreement.

For example, stunt performers have been engaged under a Schedule KIII Flat Deal Stunt Coordinator contract rather than on the appropriate weekly Schedule HII contract. The producer believes that such engagement will allow them to utilize the stunt performer according to the terms and conditions of the Flat Deal inclusive of residuals. Unless it can be conclusively demonstrated that the stunt performer is coordinating, the terms and conditions of the Flat Deal may not be applicable. The union is pursuing claims on this issue and will continue to challenge any miscategorization of stunt performers that it discovers.

The following language is from the Producer-SAG-AFTRA Codified Basic Agreement and any request by the producer that a performer waive his right to engagement under Schedule KIII is a violation of the CBA if the producer has not received SAG-AFTRA’s consent to such a waiver. SECTION 11. AGREEMENT AND SCHEDULES INCORPORATED IN PERFORMER'S CONTRACT – WAIVERS

C. Producer agrees that no waiver by any performer of any term of this Agreement, including the appropriate Schedule, shall be requested of the performer or effective unless the consent of the Union is first had and obtained. Such consent may be oral, but the Union agrees that all oral waivers will be confirmed by it in writing.
