Because of the inherent complexities in agency relations today, SAG-AFTRA has been asked to clarify the role of its franchised agent community in the Philadelphia market. In particular, SAG-AFTRA has been asked to define the contractual duties assigned to our franchised agencies under the SAG-AFTRA agency regulations.

Section I (C) of Rule 16(g) defines a talent agent as someone, “who…offers to or does represent, act as the representative of, negotiate for, procure employment for, counsel or advise any member of [SAG-AFTRA] in and about and in connection with or relating to his employment or professional career as an actor in the production of motion pictures…”

Section I (S) of Rule 16(g) defines a personal manager as someone, “whose services are limited to counseling and advising any member of SAG in and about and in connection with his professional career as an actor. A personal manager who performs services for a member of [SAG-AFTRA] shall not be deemed to be an agent unless such services include solicitation of employment…or the personal manager holds himself out as an agent or engages generally in the business of an agent.”

Franchised agents (as well as the SAG-AFTRA members they represent) are fully protected by, and bound to, the terms and conditions of the SAG-AFTRA agency regulations. For our members’ convenience, a list of the union’s franchised agents is appended to the bottom of this notice.

Please note that representational relationships with non-franchised agents who procure employment for SAG-AFTRA members may not satisfy your membership requirements to your union. Agents in Philadelphia who are not franchised are outside SAG-AFTRA’s jurisdiction, and our members should be careful not to place themselves in violation of SAG-AFTRA membership rules by deciding to work with such agencies, and potentially open themselves up to disciplinary review from the union

Should you have any further agency-related questions, please do not hesitate to contact SAG-AFTRA’s Professional Representatives Departments at (323) 549-6745 in Los Angeles, (215) 430-6354 in Philadelphia or by email at agency@sagaftra.org.
