National Labor Relations Board Authorizes Issuance of Formal Complaint Against Spanish Broadcasting System for Egregious Unfair Labor Practices

LOS ANGELES (September 13, 2017) – After a thorough investigation, Region 31 of the National Labor Relations Board (NLRB) in Los Angeles will move forward with a formal complaint on unfair labor practice charges filed by SAG-AFTRA against Spanish Broadcasting System (SBS), owner of two popular Los Angeles Spanish-language music stations, LA RAZA (KLAX/KXOL 97.9 FM) and MEGA (96.3 FM). 

The NLRB – the governmental agency empowered with investigating, prosecuting and remedying unfair labor practices – has authorized issuance of a formal complaint against SBS, alleging that SBS engaged in severe and callous violations of the National Labor Relations Act (NLRA), as follows:

• SBS unlawfully fired seven of its unionized employees (25% of the workforce) in retaliation for their union activities, in an effort to decimate the Union; and unlawfully failed to give SAG-AFTRA an opportunity to bargain about the terminations.
• SBS unlawfully used a long litany of bad faith bargaining tactics, including:

1. performing meaningless “surface” bargaining;
2. delaying and refusing to meet with the Union;
3. failing to send an agent with authority to bargain to the table;
4. refusing to discuss economics;
5. failing to furnish information necessary and relevant to bargaining;
6. direct dealing with employees; and,
7. making unilateral changes to employees’ health plans.

SBS interfered with, restrained, and coerced employees in the exercise of their rights under the NLRA by:

1. offering employees severance pay in exchange for agreeing not to discuss their terminations with SAG-AFTRA;
2. coercively interrogating employees about their union activities; and,
3. threatening unit employees that they would not be eligible for promotions because of their union activities.

Additional allegations are being reviewed and scrutinized at NLRB headquarters in Washington D.C.  SAG-AFTRA has requested that the NLRB expeditiously issue a complaint, set a quick  trial date, and go into federal district court to obtain an injunction to get the terminated employees back to work immediately and bring this lawless employer to justice.

SAG-AFTRA President Gabrielle Carteris said, “The National Labor Relations Board’s findings underscore what we have been saying all along: For nearly a year, SBS has failed to negotiate a fair contract with the union, and refuses to engage in good faith bargaining over economics, including wages. SBS’s blatant disregard for workers’ rights cannot and will not be tolerated. I want to thank all of the SAG-AFTRA members who stepped up and spoke up. Their passion for justice and their voices are an important part in this fight.”

On August 1, 2016, talent performing on-air services at LA RAZA (97.9) and MEGA (96.3) voted to join SAG-AFTRA by an overwhelming majority, making them the first Spanish-language radio stations to organize in Los Angeles. “We welcome this decision by the National Labor Relations Board,” said SAG-AFTRA National Executive Director David White. “This is the first step towards rectifying an unlawful situation and we remain committed to negotiating a fair and just contract for SBS employees. They deserve nothing less.”

LA JUNTA NACIONAL DE RELACIONES DEL TRABAJO AUTORIZA LA EMISIÓN DE UNA DENUNCIA FORMAL CONTRA SPANISH BROADCASTING SYSTEM POR PRÁCTICAS LABORALES ATROCES E INJUSTAS

Los Ángeles (13 de septiembre) – Después de una investigación exhaustiva, la Región 31 de la Junta Nacional de Relaciones del Trabajo (NLRB, por sus siglas en inglés) de Los Ángeles avanzará con una denuncia formal por cargos de prácticas laborales injustas presentada por SAG-AFTRA contra Spanish Broadcasting System (SBS), propietarios de dos estaciones populares de música en español de Los Ángeles, LA RAZA (KLAX / 97.9 FM) y MEGA (KXOL/96.3 FM).

La NLRB -la agencia gubernamental facultada para investigar, enjuiciar y solucionar las prácticas laborales injustas- ha autorizado la emisión de una denuncia formal contra SBS, alegando que SBS ha cometido violaciones severas e inexorables de la Ley Nacional de Relaciones del Trabajo (NLRA, por sus siglas en inglés) en la siguiente manera:

• SBS despidió ilegalmente a siete de sus empleados sindicalizados (25% de la fuerza laboral) en represalia por sus actividades sindicales, en un esfuerzo por diezmar al sindicato; e, ilegalmente, no le dio a SAG-AFTRA la oportunidad de negociar estos despidos.
• SBS utilizó ilegalmente un gran número de tácticas de negociación de mala fe, tales como:

1. realizaron negociaciones "superficiales" inútiles;
2. retrasaron y se rehusaron a reunirse con el sindicato;
3. no enviaron un agente con autoridad a las negociaciones;
4. negándose a discutir aspectos financieros;
5. no proporcionando la información necesaria y pertinente a la negociación;
6. sostuvieron trato directo con los empleados; e,
7. efectuaron cambios unilaterales en los planes de salud de los empleados.

SBS interfirió, restringió y coaccionó a sus empleados en el ejercicio de sus derechos bajo la NLRA al:

1. ofrecer a los empleados una indemnización por desempleo a cambio de acordar no discutir sus despidos con SAG-AFTRA;
2. interrogar con coerción a los empleados sobre sus actividades sindicales; y,
3. amenazar a los empleados de la unidad que ellos no serían elegibles para promociones debido a sus actividades sindicales.

Otros alegatos están siendo revisados y examinados en la oficina central de NLRB en Washington D.C. SAG-AFTRA ha solicitado que la NLRB expida rápidamente una queja, establezca una fecha de juicio pronta y vaya al tribunal federal de distrito para obtener una orden judicial para que los empleados despedidos vuelvan al trabajo inmediatamente, y traer a este empleador sin respeto por la ley ante la justicia.

La presidenta de SAG-AFTRA, Gabrielle Carteris, dijo: "Las conclusiones de la Junta Nacional de Relaciones del Trabajo subrayan lo que hemos estado diciendo todo este tiempo: Durante casi un año, SBS no han negociado un contrato justo con el sindicato y se niega a negociar de buena fe sobre aspectos económicos, incluyendo los salarios. El flagrante desprecio de SBS por los derechos de los trabajadores no puede ni será tolerado. Quiero agradecer a todos los miembros de SAG-AFTRA que se presentaron y expresaron su apoyo. Su pasión por la justicia y sus voces son una parte importante en esta lucha."

El 1 de agosto de 2016, el talento al aire de LA RAZA (97.9) y MEGA (96.3) votó a favor de unirse a SAG-AFTRA por una mayoría abrumadora, convirtiéndose en las primeras estaciones de radio de habla hispana en sindicalizarse en Los Ángeles.
