Please note, KMR has inactivated its franchises in the Los Angeles, New York and Atlanta Locals as of March 22, 2024, under the AFTRA Agency Regulations Rule 12-C.

The effect of the inactivation is as follows:

  • No member of SAG-AFTRA may hereafter engage, use or deal through this agency.
  • All SAG-AFTRA agency contracts in force between this agency and the members of SAG-AFTRA are ipso facto and without further notice terminated except that the agency may retain and collect any commissions earned under said contracts prior to the inactivation of the franchise.
  • Members shall not be under any obligation to pay commissions to the agent on any money earned by members after the termination of SAG-AFTRA agency contracts, even though such monies are earned by members on employment contracts in existence at the date of termination of the agency contracts.
  • If any member has signed a non-conforming agency agreement with this agency (i.e. an agency contract not approved by SAG-AFTRA), we strongly advise you to consult with independent legal counsel to determine your rights and obligations thereunder. Please note: SAG-AFTRA does not recognize any non-conforming contract as valid. 

No SAG-AFTRA member may sign any new agency contract with this agency as of the date of this notice.

Please note that any TV/Theatrical check authorizations on file with SAG-AFTRA are automatically terminated as of the date of this notice. However, performers wanting to terminate Commercials check authorizations will have to act in order to do so by directly contacting your employer/paymaster. Commercial residuals are not processed through SAG-AFTRA.

NEXT STEPS: Procedure for Filing a Claim Against Your Agency for Undistributed Funds

In order to start a claim against this agency, please provide the following information to SAG-AFTRA by emailing agency@sagaftra.org:

  • Your name, phone number, and SAG-AFTRA IDN.
  • The total amount of the claim (calculated for commercials by finding 10% of the gross amount of the outstanding checks [for the agency's commission] and subtracting it from the net [after tax] amount of the outstanding checks). Any supporting documentation from the agency regarding the dispute (such as emails, text messages, etc.).
  • Copies of the outstanding checks and their accompanying stubs (or a talent payment report with the same information, which verifies the union status of the project and gross and net amounts of each payment). This can be obtained by contacting the payroll company which processed the job.
  • Copies of the front and back of each outstanding check bearing the agency's endorsement (sometimes referred to as “canceled checks”) to demonstrate that it was the agency who received and cashed/deposited the checks specifically (and not that they were just cashed), which can also be obtained by contacting the payroll company who handled the job). 
  • Any other relevant information. 
  • Please note that based on the number of claimants coming forward (and the time constraints on both performers and payroll companies who will work to compile the necessary proofs of loss for you), we are extending our deadline for providing those necessary documents to Friday, April 19, 2024 in order to allow additional time for all parties. However, please continue to press paymasters/employers to get you that documentation in the interim.
